Your rights under Albanian law
Albanian law on compulsory motor insurance gives injured people clear rights, whatever their nationality.
- You claim directly from the insurer of the vehicle at fault. You do not have to pursue the driver personally.
- For injury or death, the insurer must respond within 90 days and, once an amount is agreed, pay within 14 days.
- Both financial and non-financial damage are covered: medical costs, lost earnings, loss of working capacity, pain and suffering.
- Passengers are covered, including those getting in or out of the vehicle.
- If the vehicle at fault was uninsured or not identified, the Compensation Fund pays.
- If the vehicle at fault was foreign-registered, the claim goes to the Albanian Insurance Bureau.
- If the insurer does not respond, disputes the amount or refuses to pay, the case can go to court.
Law no. 32/2021 on compulsory insurance in transport, Articles 9, 10, 18, 25, 28 and 41.

What to do after an accident in Albania
If you are still in Albania, these steps protect your claim.
Get medical care
Call 127 for an ambulance. See a doctor the same day, even if you feel fine, and keep every medical document.
Call the police
Call 129. When someone is injured, the police make a report and the case goes to the prosecutor. Note the police station and case number.
Record the scene
Photograph the vehicles, number plates, injuries and the road. Take the names and phone numbers of witnesses.
Get the other driver's details
Name, licence, number plate, insurance company and policy number. For foreign vehicles, photograph the green card.
Do not sign anything from the insurer
Do not accept an offer or sign a statement before getting advice. Once signed, you may not be able to claim more.
Questions from foreign clients
Do I need to come back to Albania?
Usually not. You sign a power of attorney in your country and we handle the case here. If a court or medical expert needs you in person, we tell you well in advance.
I rented the car. Am I still covered?
Yes. As a passenger or as a driver who did not cause the accident, you can claim from the insurer of the vehicle at fault.
The other driver drove away. What now?
If the vehicle is not identified, the claim is made to the Compensation Fund.
How long does it take?
The insurer has 90 days to respond to an injury claim. If the case goes to court, it takes longer. We keep you updated at every step.
What does it cost?
No win, no fee. Our fee is a percentage of the compensation you receive, agreed in a written contract before we start. Your first phone consultation is free.
